What to Do if Pulled Over or Arrested in Maryland

If you are pulled over under suspicion of driving under the influence or for any traffic violation, how you conduct yourself can have a big influence on whether you are cited, let go, or if further investigations are undertaken by the police which eventually lead to your arrest. Likewise, if you are arrested, the things you say or do (or don’t say or do!) can have a strong impact on the ultimate disposition of your case. See below for tips on what to do if pulled over or arrested in Glen Burnie or Columbia, and contact an experienced Maryland criminal defense lawyer at the Law Offices of Todd K. Mohink, PA as soon as possible.

DUI Stops

If you are pulled over under suspicion of DUI, the less said, the better. You may be required to offer proof of your identity (license and registration) and to submit to certain tests, but you are not required to answer questions such as, How much have you had to drink tonight? or Where are you coming from? Whether you choose or decline to answer such questions, note that from the very moment you are pulled over, if not before, the officer is observing everything about your physical demeanor and cognitive state to determine whether there is enough evidence to arrest you for DUI.

The officer may require you to perform sobriety tests, and refusal to comply can lead to an immediate suspension of your license and other consequences. Don’t worry, though. If unreliable field sobriety tests are given, or breathalyzer or blood tests are incorrectly administered, your attorney can challenge the results in court and argue for the suppression of this evidence, or even a reduction or in charges or dismissal of the case against you.

Drug Traffic Stops

Drivers are frequently pulled over in Maryland and arrested for drug trafficking based on what drugs the police may find in the driver’s possession. This drug traffic stop may have been conducted in violation of your constitutional rights, so you should definitely contact our office for a review of your case.

If pulled over, you should cooperate with the directives given to you by the officer, including getting out of the car if ordered to. Cooperation, however, does not mean you have to consent to a search. If the police are asking for your permission to search, they probably don’t have the right to search unless you let them. In this situation, you are within your rights to politely decline consent to search.

If Arrested

If the police do place you under arrest, it is important to remain calm and respectful. If you resist or act our physically, you may only end up with more charges being filed against you. Cooperate, but don’t consent to a search. However, the police do have authority to conduct a limited search of your person and immediate surroundings when you are arrested, so don’t physically interfere if they conduct a search. If their search exceeds their lawful authority, your attorney can argue the issue in court.

You have probably seen enough TV shows to know that at this point that you have the right to remain silent, but the police will tell you anyway. Heeding this advice is probably the best thing you can do to position yourself for a positive outcome in your case. It is true that anything you say can and will be used against you. This applies not only to anything you say to the police directly, but also things you say on the phone at the police station or in a holding cell which are overheard by officers or other people who inform the police. Simply put, don’t talk to anyone until you have talked to a lawyer.

Speaking of lawyers, the sooner you request to talk with your lawyer, the better off you will be. A lawyer from the Law Offices of Todd K. Mohink, PA will go to work right away advising you, protecting your rights, and working to get your case resolved as quickly and effectively as possible.
