Premarital Agreements for Same-Sex Couples

Beginning in January 2013, Maryland law will grant same-sex couples the right to marry. If you are considering this step, it is wise to create a premarital agreement. As with opposite-sex couples, a premarital agreement can prevent future contention and expensive litigation, should the marriage someday end in divorce. It is a legal contract that often addresses:

  • Your property division rights for joint assets
  • Your debt division responsibilities for joint debts
  • Which assets and debts are marital and which are separate
  • Your child custody and visitation rights
  • Your spousal support (alimony) expectations
