Court Order Enforcement in Maryland

There is something uniquely humbling about witnessing a judge deliver a decision. Maybe it’s the suspense. Maybe it’s the stakes involved. It’s difficult to say with any certainty which factor or factors are at play. But, regardless, there is a certain weight that many witnesses tend to feel in that moment. For proof, just ask one high school basketball star who fainted when his sentence was read aloud by his judge.

Despite the gravity of a judge’s decision, and the myriad ways in which those decisions can be enforced, some interested parties fail to comply with the court’s decisions. In this case, it is possible to petition the court for an enforcement of the decision in the future.

When the Court’s Order Isn’t Followed

Imagine this: you’ve brought your spouse to court for a divorce proceeding. It was a particularly emotional process. You couldn’t come to an agreement, so your case went to trial. After weeks of testimony and deliberations, the divorce court judge decided that custody would be split and that your ex-husband would be required to provide spousal and child support payments. Case closed, right? In most cases, if there’s not an appeal filed, yes. However, in some scenarios, one party fails to comply. There are few things more frustrating than that kind of insubordination, both for the unrecompensed party and the courts. Fortunately, there are a number of ways in which the irresponsible party can be encouraged to comply with the court’s instructions.

The Tools of the Courts

Contemptuous behavior is hardly ever suffered by the courts. The reason is twofold. On the one hand, courts have a duty to declare and provide justice for all interested parties. If one individual can unilaterally disobey the court’s orders, then justice would be denied. The other reason is more self-interested, but equally as important. Imagine if the gravitas described above did not exist, and people could disobey the courts with impunity. That’s a justice system that would not function in the United States.

Without due respect, courts’ decisions would be essentially meaningless. Therefore, courts have an interest in maintaining the respect of the entire society. Happily, judges have a number of tools at their disposal in order to procure compliance. They include:

  • Withholding one’s federal tax return
  • Garnishing one’s wages
  • Suspending the offending party’s motor vehicle license

Whenever you can affect someone’s wallet, you can get their attention pretty quickly. That’s exactly what these methods are intended to accomplish. With the right legal team, the path to enjoying the justice you deserve can be direct.
