Have you seriously considered how effective a prenup can be?

When a couple makes the decision to get married, things will suddenly get very busy once the initial celebrations with family and friends are over, and the final congratulations from co-workers are offered.

That's because the wedding planning officially gets underway, meaning the next several months will be dedicated to performing such important tasks as picking a venue, meeting with planners, selecting floral arrangements, making a guest list and planning a honeymoon.

Surprisingly enough, there is one very important aspect of comprehensive wedding planning that many people choose to either consciously ignore or dismiss offhandedly: the execution of a prenuptial agreement.

The reasoning behind this is generally twofold: 1) most people could find the notion of planning for their divorce in the months leading up to their wedding unromantic, and/or 2) most people believe that only those with a significant amount of assets have any business executing a prenuptial agreement.

Regarding this last point, it couldn't be further from the truth, as couples of any age or income level could benefit significantly from executing a prenuptial agreement. As for the first point, it's important to look at things from a more practical perspective and consider all that this legally binding document can do.

  • Establish rights, expectations and obligations concerning property division, spousal support and child custody/visitation.
  • Make the divorce process proceed in a much more efficient and effective manner.
  • Provide protection from the debts incurred by the other spouse.
  • Preserve ownership of assets brought to the marriage.
  • Protect assets for those children brought up in blended families.

This is not to mention how sitting down to execute a prenuptial agreement can actually bring a couple closer together, as they learn more about one another's views on finances, children and plans for the future.

At the Law Offices of Todd K. Mohink, PA, we have extensive experience negotiating and drafting prenuptial agreements, and understand how this can prove to be a delicate matter for many couples. As such, we will always handle such matters with not only the necessary skill, but also with the necessary sensitivity.
